Competition law

VMF advises and represents domestic and international clients on Antitrust and Competition laws in Argentina:

Some of the aspects regulated by Antitrust and Competition laws are:

Protection of competition (Antitrust): by regulating merger and acquisition operations the State seeks to prevent conducts and activities that restrain market competition and potential abuse of dominant positions.

Unfair competition: the applicable legislation attacks unfair or wrongful practices that restrict the freedom to compete.

Our professionals file petitions and proceedings before the pertaining regulatory agencies in charge of enforcing antimonopoly rules, including the National Agency for the Defence of Competition (Comisión Nacional de Defensa de la Compentencia) and the Internal Trade Ministry. Our professionals act in litigation related to competition laws, unfair competition, and abuse of dominant position.

This practice is extremely important in multinational transactions that require coordinating service of notice in different countries and regions and complying with the different requirements applicable in each jurisdiction.

Providing advice on these matters requires a thorough understanding and a detailed analysis of each of the markets where the negotiations take place in order to reliably determine, and occasionally contest, the applicable regulations.

Members of our firm have participated in the drafting of the regulations and cooperated in the implementation of some of these rules. VMF has therefore an additional advantage when advising on these issues.
